Regulations and Terms of Use (hereinafter: "the Regulations")
Welcome to the BRAVO BAZAAR ELEKTRONİK SANAYİ VE DIŞ TİCARET LİMİTED ŞİRKETİ company (hereinafter: “BRAVO BAZAAR ELEKTRONİK SANAYİ VE DIŞ TİCARET LİMİTED ŞİRKETİ”or “the company”), our whole purpose is to manage the purchase experience for you in the Turkish market, to assist you in purchasing the products and sending them to the worldwide.
INTRODUCTION
ShopGo services are provided through the website operating at https://shopgobravo.com (and any other address at the company’s discretion) (hereinafter: “the website”).
The service is operated by BRAVO BAZAAR ELEKTRONİK SANAYİ VE DIŞ TİCARET LİMİTED ŞİRKETİ. More information about the service can be found in the definition of the term “service” found in the definitions section of these regulations (hereinafter: “the service”).
These regulations come to explain and regulate the procedure for purchasing products through the company and how to use the website.
The regulations, including the privacy policy that appears on the website which is an integral part of these regulations https://shopgobravo.com/en/privacy-policy/ as well as the additional instructions or guidelines that may appear during the use of the service below will be called together: “the binding documents”. To the extent that the user of the website (hereinafter: “the user”) does not agree to the binding documents and/or to the additional conditions detailed on the website, and/or to the extent that we do not wish to act according to them, then he must refrain from using the website and the services offered on it and leave it immediately and at this time.
You, the user, are requested to read the binding documents carefully, as they define your rights and obligations in relation to the use of the service and constitute a binding agreement between you and the company. Please note that the required documents may change as needed, so we recommend updating them from time to time. If you do not agree to the terms of the aforementioned binding documents, all or part of them, you must refrain from using the service.
The company reserves the right to update the regulations from time to time and the validity of the update will apply immediately upon its publication.
The information, services and products offered on the site are subject to agreements with third parties, therefore the company may, at its sole discretion, update and/or cancel and/or remove an application, service, product or specific content without prior notice, and the user shall have no claim and/or a demand against the company and/or anyone on its behalf for this.
The company reserves the right to terminate or limit the use of the services by any user without prior notice and at its sole discretion.
In documents that require the singular also the plural in meaning and vice versa, and the masculine also the feminine in meaning and vice versa, all according to the case.
The binding documents are worded in the masculine gender for convenience only and refer to both genders.
The titles of the regulations are used for the convenience of the parties only and will not be used in any case to interpret the regulations and/or its terms.
Our operating hours are Monday through Friday, from 9:00 a.m. to 6:00 p.m. and on Saturday from 9:00 a.m. to 1:00 p.m. (Istanbul time). The office and warehouse are closed on weekends and holidays (Turkish).
DEFINITIONS
“IMPORT RESTRICTIONS” : Personal imports are limited to the amount of personal consumption according to the product. There are also items that cannot be imported into most countries at all and/or require standardization. It is the user’s responsibility to check that the product he wishes to purchase is not on the list of prohibited products for import and/or meets other regulatory requirements and that the quantity does not exceed the personal import limit. The user will bear all the results and/or expenses arising from his failure to comply with the import restrictions. The user alone will be responsible for producing any approval from an authority in his country as required by customs (for example, the approval of the Ministry of Transport and/or the Ministry of Health regarding products under the supervision of these bodies). Any delay in producing the required document may result in a delay in delivery and additional costs, such as: storage costs.
“THE SERVICE” : the website and the services provided through it. More information about the service we provide, its features and the possibilities of using it, can be found under the heading “About the service in a nutshell” and on the relevant pages in the main body of the website, and in particular on the “Nice to get to know you” page and the “Questions and Answers” page.
“SHIPPING ADDRESS” : ShopGo provides an address in Turkey for shipping products that you have purchased yourself from local suppliers and from all countries that ship to Turkey. After the products arrive at its warehouse, ShopGo will provide repackaging services while reducing unnecessary weight, removing original packaging and shipping to your address as it is declared in his account or to the nearest distribution point to your home. Warning: opening the package may violate the rights of return, if the user wants the package not to be opened, you are asked not to use our service and leave the site immediately. It is absolutely forbidden to use the address given to the user for needs that are not related to communication between him and ShopGo.
“PRIVACY POLICY” : The website collects information about the user when browsing in the manner and under the conditions specified in the document bearing this name.
“FOREIGN CURRENCY” : in accordance with the provisions of the applicable law, prices of the services provided in full in Turkey and the service of importing loads to the user’s home as detailed in section 4.4.2 and as detailed in section 4.4.1 above shown on the website in euros/dollars will be converted when calculating the cost of the order (and before the actual payment is made) to US dollar according to Turkish Central Bank rate and as published on Turkish Central Bank’s website (hereinafter: ” Turkish Central Bank website”) the rates determined on the business day preceding the due date the calculation.
“USER” : Anyone who uses the website, provided that he/she has (in the aggregate) an active e-mail box, has a valid credit card, is of legal age and is legally competent according to any law.
“INTELLECTUAL PROPERTY” :
- The website and its entire content including but not limited to: the graphic design of the website, icons, the website logo, images, data and any other information of any kind on the website and all the content contained therein, the trademarks, copyrights, methods, trade secrets and patents related to it.
- The social media pages, including the Instagram and/or Facebook page and/or Tiktok and/or any company page that exists in any collaborative social network, and their full content including but not limited to the graphic design of these pages, icons, company logos, images , data and any other information of any kind on these pages and in all the content contained therein, the trademarks, copyrights, methods, trade secrets and patents related to it.
As for all of the above, any use in any way whatsoever, including but not limited to, copying, distribution, transmission, publication, transfer, linking, exploitation or infringement of the company’s intellectual property rights is strictly prohibited.
“SERVICES VIA MOBILE PHONE” : services such as supply updates, etc. may be provided to mobile phones. Therefore, the user will be asked to provide an active mobile phone number during registration. For more information please refer to our privacy policy.
“CONTENT” : any textual, visual, audio content, or any combination of them or part of them, as well as their design, processing, editing and way of presentation.
ABOUT THE SERVICE IN A NUTSHELL
Details about the services we provide are presented on the website page “Nice to get to know you” and also on the “Frequently Asked Questions” page. The company’s services are:
- Shipping address – “ShopGo” provides an address in Turkey for shipping products that you purchased yourself in Turkey, whether you purchased these products physically or whether you purchased these products online. Purchases can be made through the websites of these companies and also through links on the company’s website.
After the products arrive at the “ShopGo” warehouses in Turkey, the company will provide quality control and repackaging services in the sake of reducing unnecessary weight, if possible, in order to lower shipping costs and make the shipment in the best way for the customer. Also, the company will provide package consolidation services, for more details see the “Costs and Returns Policy” section.
Your use of the services constitutes authorization for “ShopGo” to open the shipping package for the purpose of checking the integrity of the product, weighing and measuring the ordered product, calculating the handling and shipping fees and repackaging it (the company will not be responsible for products that have arrived to it damaged from the supplier and/or manufacturer and the user waives a complete waiver of any claim and/or complaint and/or demand and/or compensation and/or claim against the company for a defective product received by the company from the supplier and/or manufacturer). The package will be considered the company’s responsibility from the moment the packages are consolidated and/or the package(s) are repackaged in the “ShopGo” ’s warehouses. By repacking the package(s), you agree that you will not have any claims and/or demands and/or claims against the company regarding the damage to the ability to return the product you purchased.
Shipping to the address you provided in your country – “ShopGo” will ship the products you purchased yourself in Turkey, from the company’s warehouses in Turkey to the address you provided in your country. The calculation of the shipping fees will be done by entering the product data in the “cost calculator” on the website, and then by adjusting the data received according to the “price by weight” table later on the same page on the website, under the “cost calculator” (for more details, see the “shipping cost” section in the condition use these).
“ShopGo” ‘s express delivery can be received at a lower cost by using the distribution points you choose near your home, and this only up to a physical or volumetric weight of 5 kg. The delivery can be delivered to the user’s home for an additional fee and in accordance with the price lists found on the website in the “price by weight” table (for more details, see the “website delivery options” section of these terms of use).
Note that! The products presented in the service, including their prices, pictures and any information relevant to them (hereinafter: the “product information”), are not on behalf of the company, but on behalf of the businesses as they choose to display them on their websites, and therefore the company will not bear any responsibility regarding the product information.
The fact that the service on the company’s website links to the product information does not indicate that the company is responsible for, controls or supervises their content and does not constitute a guarantee for their reliability, their up-to-date, their legality, the practices of the owners of the businesses or the practices of their websites in the field of privacy and any other aspect involved. The company is not responsible for the contents to which the links lead and is not responsible for any result caused by their use or reliance on them.
The company does not guarantee that links found in the service will be correct and will lead you to an active web page, and the company may remove from the service links that were included in the past, or refrain from adding new links – everything, at its discretion. The responsibility for the product information, including their features, the correctness of their delivery to the company’s warehouses in Turkey and their price, applies to the businesses. The company is not a party to any transaction between you and the businesses that display their wares on the service. The company does not monitor, test or recommend the products that originate from the businesses, their quality, reliability. The responsibility for these products as mentioned applies to the businesses that advertise their products for sale.
Without detracting from the generality of the above in relation to the order of the results displayed in the service, the service operator may allow businesses promotion options for certain contents in the service against payment (as specified in the commercial contents section below). Promoted content will be published only in the designated areas between the pages of the service and/or on the pages of the service. In any other case, the service operator does not artificially interfere with the order in which search results are displayed in the service.
COMMERCIAL CONTENT
The company may place on the service, at its sole discretion, commercial content, such as advertisements and notices, submitted for publication on behalf of various advertisers seeking to offer products or services for sale, including information originating from supporters and sponsors, which may take on a commercial nature.
The company will not bear any responsibility for the commercial content that will be published on the service on behalf of third parties. The company does not write, check, verify or edit the content of these publications or their reliability. The sole responsibility for the commercial contents and for any result resulting from their use or reliance on them applies to the advertisers. Publishing commercial content on the service does not constitute a recommendation or encouragement on the part of the company to purchase the services, assets or products offered for sale therein.
Any transaction made as a result of commercial content published on the service will be concluded directly between you and the advertiser concerned. The operator of the service is not a party to any such transaction and will not be held responsible for the services and goods offered in the commercial content of the service or purchased through them. Commercial content in the service will often be marked as an advertisement and in any case will not affect the order of the results presented to the user. To the extent that the company decides to collaborate with celebrities and/or network influencers, and unless otherwise stated, those celebrities and/or network influencers do indeed publish the relevant content, including their recommendations, out of an objective opinion and a desire to make available quality product(s) and/or or the service to our existing and potential customers, but also in exchange for payment.
INTELLECTUAL PROPERTY
All intellectual property rights in the service as defined in the “Definitions” section of these terms of use, (except in relation to content submitted for publication on behalf of businesses) and including the copyrights on the website (including, among other things, the website’s computer code and its graphic design), on the service and in all content contained therein – are Exclusively owned by the company only, or by other third parties who have allowed the company to use these rights.
Do not copy, distribute, display publicly, perform publicly, transmit, make available to the public, modify, process, create derivative works, sell or rent any part of the above, either by you or through or in collaboration with a third party, in any way or means, Whether electronic, computerized, mechanical, optical, photographic or recording means, or in any other way, without obtaining the prior written consent of the company or the other rights holders, as the case may be and subject to the terms of the consent (as many as may be given).
The trademarks and advertisements of advertisers on the service (if any) are the property of these advertisers only. They also may not be used without the prior written consent of the advertiser.
REMOVING CONTENT FROM THE SERVICE
The company respects the rights of others, including the intellectual property rights of third parties as well as their right to goodwill and privacy. If you believe that any content published on the service violates your rights, you are welcome to inform the company of this in writing, using the contact information provided on the website. Steps to be taken by the company, to the extent that they are taken, relying on information that will be transferred to it, will not constitute proof of any violation of any right and they will be taken in accordance with the provisions of the law.
RESPONSIBILITY
Wherever the company’s responsibility is detailed in the binding documents, the responsibility of its employees, managers and workers by its authority or on its behalf will also be meant.
The use of the service and all content included in it will be done at your sole and full responsibility and the company will not be responsible for any direct or indirect damage caused to you or anyone on your behalf, or to any other third party, including any loss, loss or expense, related to, or arising, directly or indirectly from the information that the businesses advertise through the service. The service can be used as it is (AS IS). It is not possible to adapt to the needs of each and every person. You will not have any claim, claim or demand against the company regarding the features of the content and services, their capabilities, their limitations, the rules that apply to them and their suitability to you and your needs.
Any decision you make in relation to the contents published on the service is your sole responsibility. The company does not guarantee that the contents, products and services of third parties, including those of businesses presented in the service, will be complete, correct, legal or accurate, or will meet your expectations and requirements. The company will not bear any responsibility for any result resulting from them, or from using them, or from relying on them. Use of the service is at your own risk.
The company does not guarantee that the service will not be interrupted, will be provided in order or without interruptions, will take place safely and without errors, and will be immune from unauthorized access to the company’s computers or from damages, breakdowns, malfunctions or failures – and all, in hardware, software, communication lines and systems, at the company or Who is its supplier?
The company will not be held responsible for any damage resulting from the loss of your details (if provided), the information in your account or disruption of these details – either fully or partially, as a result of a failure in your or the company’s computer systems, or someone on its behalf.
INDEMNITY
You undertake to indemnify the company, its employees, managers or anyone on its behalf, for any damage, loss, loss-profit, payment or expense incurred by them – including attorney’s fees and court costs – due to a violation of these terms of use or any of the binding documents.
SERVICE CHANGES AND CESSATION OF ACTIVITY
The company is entitled to change from time to time the structure of the service, its appearance and design, the scope and availability of the services, the contents and the possibilities of advertising therein, and will be entitled to change any other aspect involved in the service – and everything, without having to notify you in advance. Such changes will be made, among other things, considering the dynamic nature of the Internet and the technological and other changes occurring in it. By their nature, changes of this type may involve malfunctions or initially cause discomfort, etc., therefore, in your actual use of the website, you will not have any claim, claim or demand against the company for making such changes or malfunctions that will occur during their implementation.
The company may at any time stop the activity of the service, in whole or in part, temporarily or permanently. The company is even entitled to stop the activity of the service from time to time for the purpose of maintenance, repair, upgrade and improvement of the service. The company will do its best to reduce the periods of time during which the service will not be active. If possible, the company will publish a notice on the website about the termination of the service activity a reasonable time in advance. Upon termination of a certain activity in the service, the company will keep the content included in this activity for an additional reasonable time and then will be entitled to delete it without keeping any backup of it and without giving notice of this.
THE USE OF THE SERVICE
You may use the service in accordance with the rules listed below. Do not use the service in any other way, unless you have received the express consent of the operator of the service, in advance in writing:
- Do not use the service in a way that constitutes or may constitute an offense according to any law, or a civil wrong, in accordance with the provisions of any law, or in a way that infringes the rights of any third party.
- Do not copy and use content from the service, including other services, electronic publications, print publications, etc., for any other purpose
- Do not activate or allow to activate any computer application or any other means, including software of the type Crawlers, Robots, etc., for the purpose of searching, scanning, copying or automatic retrieval of contents from the service. In this rule, you must not create and do not use such means to create a collection, collections or A database that will contain content from the service.
- Do not display content from the service in any way – including through any software, device, accessory or communication protocol that changes their design or removes any content from them, in particular advertisements and commercial content.
- Do not link to the service and content from any source that contains pornographic content, content that encourages racism or illegal discrimination, or that is against the law, or that encourages activity that is against the law, or whose publication is against the law.
COSTS AND RETURN POLICY
Payment to “ShopGo” will be made by credit card or by any payment method allowed by the credit company, which is a third-party company that provides clearing services to the company. Purchase services or as the service called “WeGo Service” are services that performed by the “ShopGo” as an operator. In this service we buy the products as it is placed in the order considering the product’s details and specifications the as the user specified in his order. We “ShopGo” bear no responsibility for the products’ running out of stock any time. The payment for the purchase services fees $12.5% of the purchased products, this is due to the costs involved in buying and paying for the purchase.
Storage – we are happy to provide 14 days of free storage for any package that arrives at our warehouse. Beginning on the 15th day, a storage fee of $3 per week of storage or part thereof will be charged for each package.
Consolidation of packages – Consolidation of the packages has a fixed cost of $3.80 (hereinafter: “package consolidation price”) in addition to the shipping cost of the consolidated package. By providing this service, we allow you to purchase products from a variety of websites or make repeated purchases on the same website, with a gap of up to two weeks, and combine all orders into one package for delivery to your country. It is possible to combine several packages that were ordered from the same supplier and even from different suppliers, when the purpose of the consolidation is to repack and ship them as one package to the distribution point or to the home according to the various courier prices listed on the website. It is your responsibility to check that the consolidation of the packages will not lead to a situation where you will be required to pay VAT (for example when the total cost of the products in the package exceeds $75). If the user placed an order from a single seller and the seller split the same order into several shipments, the consolidation of the packages will not be charged.
In order to perform the consolidation, you are required to enter the ‘My Orders’ page. If there are more than two packages on the order page, a message will appear regarding the possibility of combining the packages. Clicking on the message will take you to a separate window where you can select the packages you want to combine. After marking the packages requested for consolidation, and confirming the consolidation request, you will receive a notification that the “ShopGo” team will get back to you with an update regarding the new handling and shipping fees within 7 business days. Upon receipt of a notification regarding the new handling and shipping fees, and in order to complete the order, you will have to settle the payment for the new handling and shipping fees plus package consolidation fees. Please note, packages for which a consolidation request has been sent will not be able to be split again. Orders cannot be canceled after receiving confirmation from the company. The order will be considered approved after “ShopGo” confirms the receipt of the order in its warehouse in Turkey.
Returning products – as part of our service, we allow a package to be returned to the supplier as long as the package has not left the warehouse and refunded to your account in ShopGo Wallet system. Additionally, for the return and storage service, “ShopGo” will charge a total of $10 per return, subject to the carrier’s return terms. That is, if the shipping back to the supplier is paid – you will be charged for the cost of shipping the package in addition to paying $10 to “ShopGo” for each return. If the return shipping is at the supplier’s expense, you must send us a shipping label from him and we will make sure that the product is shipped according to its return conditions, and with an additional payment of $10 to “ShopGo” for each such return.
TERMS AND CONDITIONS:
The service of returning products that left the warehouse in Turkey does not yet exist. In the future, when this service becomes possible, the terms of use will be updated accordingly and the user will receive a notification on the website about the update of these terms of use, when this service is provided, prior to the return, the company’s customer service must be contacted.
In the future, when this service is provided, then; the cost of shipping an item that has already arrived to your address and is sent back to our office will be at your expense.
- Returning an item to the supplier does not cancel the storage fees of the package in our warehouse.
- The service is intended for returning the package to the sender/seller/manufacturer from which the order was made only. Subject to the costs of returning products indicated in the “Returning products” section above.
Registering on the website: Registering on the website, including the creation of the username and password, is personal and non-transferable, in return or not.
Minors are not allowed to register on the site. Registering on the website constitutes a declaration that you are over 18. In order to register on the website and establish your personal account (the ‘Account’), you are required to fill in a number of details, including your full name, residential address, valid email address as well as a telephone number. You must ensure that the account information you created is current and accurate. “ShopGo” reserves the exclusive right to refuse access to the website to any user, refuse to provide service, cancel accounts, and cancel orders at its sole discretion, among other things in cases where it discovers that the customer is not 18 years of age or older and/or in the case where the customer has violated the terms of use of the website. This is at its sole discretion and without prior notification to the customer.
Unclaimed package: A package that is stored in our warehouse for more than 30 days without a response to our inquiries to the user, will be defined as “unclaimed” and will be donated to one of the non-profit organizations in Turkey after 60 days. “ShopGo” hereby removes any responsibility for this package, and in the process delivers the same package to the user who ordered it.
Request to cancel shipping/consolidate packages: The warehouse invests discretion, and the greatest effort to pack and consolidate each package in the most optimal way and send the packages out as soon as possible after payment. As a rule, it is not possible to cancel the consolidation of packages, but if a special request is received from the customer and the cancellation is possible, then for cancellation of consolidation/shipping, an additional charge of $10 will be charged.
Transaction cancellation: If it is a non-standard shipment, there may be transaction cancellation costs at the discretion of the “ShopGo” company up to 20% of the transaction amount.
MAKE AN ORDER “WEGO” OR “YUGO”
After registering on the website and setting up the account, you will receive a shipping address in Turkey. The address given to you must be entered when placing any order for products from the various websites that ship to Turkey. After making the purchase from the supplier, the order will be sent to our warehouse address in Turkey. The date of arrival of the order at “ShopGo” warehouses depends on the agreements between you and the seller at the time of purchase. After the package arrives at the warehouse, within two business days (depending on the operating hours), the handling and shipping fees (‘handling and shipping fees’) will be calculated according to the volume of the product, its weight and additional costs. At the end of two business days, the order will be updated on the website in your personal area and an email will be sent to the address you entered when registering for the service. The update on the arrival of the package at our warehouse will be sent to the user after it has been reduced and the original packaging has been removed. In order to complete the shipping order process, you are required to load and upload the purchase invoice to the website indicating the value of the goods. It will be clarified that the value of the goods listed on the invoice you received from the supplier for your purchase, is transferred to the tax authorities in your country and this is how the duty that you are required to pay for the purchase you made from the supplier is actually calculated. Any mistake in the invoice amount or uploading a non-standard invoice may lead to incorrect charges from the customs authorities and even delay the process of releasing the package from customs, and therefore you are obliged to upload the purchase invoice in accordance with the requirements stated on the website. It will be clarified that you bear the full responsibility for the standard raising of an invoice in accordance with the tax requirements in your country as mentioned above and any additional charge caused by a non-standard raising on your part is the responsibility of the user and you will not have any claim and/or complaint and/or demand and/or claim of any kind against the company. If you are delayed in uploading the invoices after they appear in the personal area, “ShopGo” is not responsible for the delay in shipping times and will charge the customer additional storage fees depending on the circumstances. Your use of the services constitutes authorization for “ShopGo” to open the delivery package for the purpose of checking the integrity of the product, weighing and measuring the ordered product, The package will be considered the company’s responsibility from the moment the packages are consolidated and/or the package(s) are repackaged in the “ShopGo” warehouses.
The time of arrival of the package to the user who ordered it is within 21 business days from the moment of payment. Business days will not include the day of shipment, Saturday-Sunday or Turkish holidays and unforeseen factors (delays due to sanctions, weather conditions, customs work rate, etc.). Any responsibility for the delay in delivering the correct data to the “ShopGo” or the failure to upload the documents required to complete the shipping process in a proper manner will apply to the user and in accordance with the payment clauses for storage fees indicated above.
DELAYS IN DELIVERY TIMES
It will be clarified that all of the order execution times specified in the above paragraph, including the time of the package’s arrival to the user who ordered it, are subject to changes and delays due to heavy loads occurring during the following periods (hereinafter: “load periods”):
- Black Friday started on November 25th. The changes and delays in Black Friday times are expected to occur about a month before Black Friday until the end of January of the following calendar year after Black Friday.
- All the time the company, from which the purchase was made, publishes promotions and discounts that cause massive orders.
Therefore, the company will not commit to any of the services specified in the “order execution” paragraph above, for any time frame during the busy periods and will not bear any responsibility for any time delay however long it may be. A user who orders through the company’s website agrees, by using the website and by placing an order, to a complete waiver of any claim and/or complaint and/or demand and/or compensation and/or claim against the company for any delay during the peak periods.
SUPPLY
Warranty on shipments – “ShopGo” will allow you in the future, (when this service becomes possible, the terms of use will be updated accordingly and the user will receive a notification on the website about the update of these terms of use) to purchase insurance for the shipping phase of the products you have purchased, all through third-party insurance companies that provide product warranty service that you purchased.
The sole responsibility for the product is that of the manufacturer or supplier. Be sure to keep the warranty certificate issued by the supplier. For any demand and/or claim and/or claim regarding these products, you must contact directly the party that issues the warranty certificate or the manufacturer. The company does not bear any responsibility for the products purchased, including for products that arrived damaged from the supplier and/or manufacturer, sizes that do not match the order, wrong quantity of items, the nature of the products, their quality and suitability, including responsibility for loss of profit, business loss or any other damage, and the ordering user Through the company’s website, there is a complete waiver of any claim and/or complaint and/or demand and/or compensation and/or claim against the company for these products.
The company takes no responsibility under any circumstances for shipping fragile and delicate products. The reason for this is that the company repackages and puts the product you sent to us into the company’s bags as is, so if the supplier from whom you purchased the product used firecrackers or any other material designed to protect the product in its packaging (hereinafter: “the protective measures”), we will repackage the The product you purchased and we will add the protective measures that came from the supplier.
